What is a DUI?

DUI stands for Driving Under the Influece, which is a criminal offense in the state of Minnesota. This law applies to you when your Blood Alcohol Content level, or BAC, is between 0.04 and 0.08. If you are pulled over by a law enforcement officer under suspicion of being under the influence of alcohol, you can be tested using a breathalyzer and if proven positive can be arrested.

What are my rights?

The officers should read you your rights as they arrest you and make sure that you understand them. You have the right to remain silent, as anything you say or do can be used against you in a court of law. Your most important right is the access to legal counsel. Seek this immediately as time is critical in a case such as this. They will give you the best advice to keep out of more trouble than you are already in and help you to decide what actions you need to take in your case.

What are the possible penalties for a DUI?

In Minnesota, commonly the punishment for a DUI conviction includes the suspension of your license and taking drug and alcohol abuse educational programs. There may also be fines or a small amount of jail time. If you refuse to be tested for your BAC at the time of arrest, your license is automatically suspended for a year. These punishments can severely affect your lifestyle.
